By accessing and using Home Assist ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Home Assist provides a platform that connects homeowners with licensed contractors for home improvement projects. Our services include:

  • Contractor directory and search functionality
  • Home maintenance forecasting tools
  • Escrow payment services
  • Dispute resolution and escalation services
  • Project management tools

3. User Accounts

To access certain features of the Platform, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

4. Independent Contractor Relationship

Home Assist does not employ contractors and has no direct association with contractors listed on the Platform. Contractors are independent businesses that use our Platform for advertising and project management purposes. Home Assist:

  • Does not guarantee the quality, safety, or legality of contractor services
  • Is not responsible for contractor actions, omissions, or performance
  • Does not supervise, direct, or control contractors' work
  • Provides verification services but does not warrant contractor qualifications

5. Escrow Services

Home Assist offers optional escrow services to protect payments between homeowners and contractors. By using escrow services, you agree that:

  • Funds will be held in a secure escrow account until project milestones are met
  • Release of funds requires mutual agreement or dispute resolution
  • Escrow fees apply as outlined in our fee schedule
  • Home Assist acts solely as an intermediary and is not party to the underlying contract

6. Dispute Resolution and Escalation Services

Home Assist provides escalation services to help resolve disputes between homeowners and contractors. These services include:

  • Mediation and negotiation assistance
  • Professional guidance and recommendations
  • Access to legal support resources
  • Escalation to formal dispute resolution processes

Escalation services do not guarantee specific outcomes and are provided on a best-effort basis.

7. Homecast

Homecast provides home forecasts based on statistical data, regional averages, and typical equipment lifespans. These forecasts:

  • Are for informational purposes only
  • Do not constitute professional advice or guarantees
  • May not reflect actual performance of your specific equipment
  • Should not be relied upon as the sole basis for decision-making

8. Fees and Payment

Certain services on the Platform may require payment of fees. You agree to pay all applicable fees as described on the Platform. All fees are non-refundable unless otherwise stated.

9. Prohibited Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful or malicious code
  • Engage in fraudulent activities
  • Harass, abuse, or harm other users
  • Circumvent Platform security measures
  • Use automated systems to access the Platform without permission

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOME ASSIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify and hold harmless Home Assist, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform or violation of these Terms.

12. Modifications to Terms

Home Assist reserves the right to modify these Terms at any time. We will notify users of material changes via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

13. Termination

Home Assist may terminate or suspend your account and access to the Platform at any time, with or without cause or notice, including for violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
